CA Consumer Privacy Act Policy

SmarterHealthAI, an Esprit Communities, Inc. subsidiary company

This notice describes the rights of Californians under the California Consumer Privacy Act of 2018 (“CCPA”). The CCPA, as amended by the California Privacy Rights Act (“CPRA”), requires covered businesses such as SmarterHealthAI, which is operated by Esprit Communities, Inc., a Texas corporation, to provide certain information to California residents. SmarterHealthAI fully describes its practices to all its members and visitors in its Privacy Policy but uses this separate notice to ensure that SmarterHealthAI meets the CCPA’s requirements. This notice contains the following parts:

1. SMARTERHEALTHAI DOES NOT SELL YOUR PERSONAL INFORMATION

The CCPA requires SmarterHealthAI to disclose whether SmarterHealthAI sells or shares your personal information. SmarterHealthAI does not sell your personal information for money. Some advertising and analytics Cookies described in our Cookie Policy may be treated as “sharing” personal information for cross-context behavioral advertising under the CCPA. You can opt out of that sharing as described in Section 2.2.

2. YOUR RIGHTS UNDER THE CCPA

The CCPA provides Californians with the following rights:

2.1 Requests for Information

Like all of our members, you (or your authorized agent) can request a copy of your personal information. Authorized agents will be required to verify their identity. SmarterHealthAI also will require members to confirm, by email from their primary account email address, that they granted the agent permission to submit the request. Under the CCPA, you can also request that SmarterHealthAI disclose how it has collected, used, and shared your personal information over the past 12 months, including the categories of personal information SmarterHealthAI collected and its purposes for doing so; the categories of sources for that information; the categories of third parties with whom SmarterHealthAI shared it for a business purpose and its purposes for doing so. Companies that sell personal information (SmarterHealthAI does not) must make additional disclosures.

If you are not a SmarterHealthAI member, you can submit your request via an authorized agent. The authorized agent will be required to verify their identity, and you will be asked to confirm by email that you granted the agent permission to submit the request.

2.2 Your Right to Opt Out of Sale or Sharing

You can opt out of any sharing of your personal information for cross-context behavioral advertising by using the “Do Not Sell or Share My Personal Information” link on the SmarterHealthAI website, by adjusting your Cookie settings, or by emailing [email protected]. SmarterHealthAI also treats a Global Privacy Control (GPC) signal sent by your browser as a valid request to opt out of sale and sharing for that browser.

2.3 Your Right to Notification

Under the CCPA, a company like SmarterHealthAI cannot collect new categories of personal information or use them for materially different purposes without first notifying you.

2.4 Nondiscrimination for exercising your CCPA Rights

The CCPA prohibits businesses from discriminating against you for exercising your rights under the law. Such discrimination may include denying services, charging different prices or rates for services, providing a different level or quality of services, or suggesting that you will receive a different level or quality of goods or services as a result of exercising your rights.

2.5 Your Right to Delete Personal Information

Like all SmarterHealthAI members, you can request that SmarterHealthAI delete your personal information by closing your SmarterHealthAI account. You also can request that SmarterHealthAI delete specific information. SmarterHealthAI honors such requests, unless an exception applies, such as when the information is necessary to complete the transaction or contract for which it was collected or when it is being used to detect, prevent, or investigate security incidents, comply with laws, identify and repair bugs or ensure another consumer’s ability to exercise their free speech rights or other rights provided by law.

2.6 Your Right to Correct Inaccurate Personal Information

You can ask SmarterHealthAI to correct inaccurate personal information that we maintain about you. Members can correct most information directly in their account settings; for anything else, email [email protected].

2.7 Your Right to Limit Use and Disclosure of Sensitive Personal Information

Some information you provide, such as information about your health, account log-in credentials and precise geolocation, is “sensitive personal information” under the CCPA. SmarterHealthAI uses sensitive personal information only as needed to provide the Services you request and for other purposes the CCPA permits. If we ever use it for other purposes, you may direct us to limit that use by emailing [email protected] or using the “Limit the Use of My Sensitive Personal Information” link on the SmarterHealthAI website.

2.8 Your Right to Know and Access

You can request the specific pieces of personal information SmarterHealthAI has collected about you, and the categories described in Section 2.1, covering the 12 months before your request or a longer period where the CCPA allows.

3. THE CCPA CATEGORIES OF PERSONAL INFORMATION SMARTERHEALTHAI COLLECTS AND THE SOURCES

Our Privacy Policy describes the information SmarterHealthAI collects and its sources. This notice organizes that information around the personal information categories set forth in the CCPA.

Identifiers (e.g., real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, or other similar identifiers)

  • Information you provide directly or through your interactions with our Services (as defined in our Privacy Policy) or partners
  • Vendors that provide information to help SmarterHealthAI serve members relevant ads and understand the ads’ effectiveness
  • Information from other SmarterHealthAI members or customers

Characteristics of protected classifications under California or Federal law (e.g., your gender or age) (“Characteristics of Protected Classifications”)

  • Information you provide to SmarterHealthAI directly and inferences SmarterHealthAI makes based on that information
  • Information from SmarterHealthAI customers

Commercial information (e.g., information regarding products or services purchased, obtained, or considered)

  • Information you provide to SmarterHealthAI directly, such as to buy a Premium service
  • Your interactions with SmarterHealthAI Services
  • Information from SmarterHealthAI partners and customers

Internet or Other Electronic Network Activity Information (e.g., browsing history, search history, and information regarding your interactions with our Services)

  • Your interactions with SmarterHealthAI Services
  • Your visits to third-party sites that link to or embed SmarterHealthAI features, as needed for fraud prevention and security purposes.

Geolocation Data

  • Information you provide to SmarterHealthAI directly or through your interactions with our Services, as explained in the Privacy Policy

Professional or Employment-Related Information

  • Information you provide to SmarterHealthAI directly
  • Information from SmarterHealthAI customers, partners, or from other members

Inferences

  • Information you provide to SmarterHealthAI directly or through your interactions with SmarterHealthAI Services
  • Information from SmarterHealthAI customers and partners

Personal information described in Cal. Civ. Code §1798.80(e)(such as name, address, telephone number, education, employment history, credit card or debit card number)

  • Information you provide directly or through your interactions with SmarterHealthAI Services
  • Information from SmarterHealthAI customers or partners

Audio, electronic, visual or similar information

  • Information you provide directly or through your interactions with SmarterHealthAI Services, customers or partners

Sensitive personal information (e.g., health information you provide, account log-in credentials, precise geolocation)

  • Information you provide to SmarterHealthAI directly or through your interactions with SmarterHealthAI Services, such as your “My Page” profile, posts and messages

SmarterHealthAI uses this personal information for the purposes outlined in our Privacy Policy.

4. THE CCPA CATEGORIES OF PERSONAL INFORMATION SMARTERHEALTHAI SHARES FOR A “BUSINESS PURPOSE”

While SmarterHealthAI does not sell your personal information, SmarterHealthAI may share it to support its operational purposes in providing Services to you, as described in our Privacy Policy. These operational purposes, known as “business purposes” under the CCPA, are described below. In addition, SmarterHealthAI may share personal information at your direction, such as when you choose to communicate with other members through our Services.

4.1 Auditing Interactions

SmarterHealthAI may share the types of personal information listed in Section 3 with partners, service providers and related companies, in order to audit interactions and transactions, such as to count or verify the positioning and quality of ad impressions.

4.2 Security Purposes

In order to secure SmarterHealthAI Services, including to detect, prevent and investigate security incidents or violations of SmarterHealthAI Community Guidelines or applicable laws, SmarterHealthAI may share the types of personal information listed in Section 3 with its partners, service providers, law enforcement and related companies.

4.3 Service Improvements

In order to improve SmarterHealthAI Services (such as to identify bugs, repair errors or ensure that services function as intended) or conduct internal research and analysis to improve SmarterHealthAI technology, SmarterHealthAI may share the types of personal information listed in Section 3 with its partners, service providers and related companies

4.4 Service Providers and Other Notified Purposes

SmarterHealthAI may share the types of personal information listed in Section 3 with Service Providers, as defined by the CCPA, in order to have them perform services specified by a written contract or with others for a notified purpose permitted by the CCPA (e.g., to respond to law enforcement requests).

5. HOW TO SUBMIT A REQUEST

To exercise any of the rights described in this notice, email [email protected] with the subject line “California Privacy Request”, or use the Contact Us link at the bottom of every page of the SmarterHealthAI website. We will confirm receipt within 10 business days and respond within 45 calendar days, which the CCPA allows us to extend once by another 45 days if we tell you why. To protect your information, we will verify your identity by matching the information you give us with the information in your account, and we may ask for more information if needed. An authorized agent may submit a request for you as described in Section 2.1.

6. RETENTION OF PERSONAL INFORMATION

SmarterHealthAI keeps each category of personal information only as long as reasonably necessary for the purposes for which it was collected, as described in the SmarterHealthAI Data Retention Policy and Privacy Policy, unless a longer period is required by law.

7. MINORS

The SmarterHealthAI platform is not intended for anyone under the age of 14. SmarterHealthAI does not sell or share the personal information of consumers it knows to be under the age of 16.

8. APPLICABLE LAW

This notice is provided to comply with the CCPA, and your rights described in it are governed by California law. Nothing in this notice, the SmarterHealthAI Terms and Conditions of Use or any other SmarterHealthAI policy waives or limits any right you have under the CCPA or other California law that cannot be waived by contract. Subject to those rights, this notice and all other disputes, claims and legal matters relating to it, including any arbitration, are governed by the laws of the State of Texas, as described in the SmarterHealthAI Terms and Conditions of Use.
